Ducati Corse has won the battle against Aprilia, Honda, KTM, and Suzuki, as the FIM Court has decided today that the famous “spoiler” used by the Italian team at the Qatar GP is legal! After many weeks of speculation, the court has finally announced the final decision on this case, and as such, the Qatar GP results are now homologated and Andrea Dovizioso is the winner of the first race of the season in MotoGP.

The FIM Court of Appeal analyzed all the data and simulations that all the teams involved in this protest presented, and the final decision is that the Ducati “spoiler” is legal, because it is intended to solely lower the rear tire temperature, as Ducati always said it was.

Aprilia, Honda, KTM, and Suzuki, now have to decide if they will pursue with their actions against Ducati, since there’s still a final appeal that’s allowed, to the Court of Arbitration of Sport (CAS) in Lausanne, Switzerland. They have five days from now to present that appeal if they wish to do so.

According to the FIM Court of Appeal, Ducati Corse is now allowed to continue using the “spoiler” as they wish, since this element is now considered legal by the FIM. Gigi Dall’Igna had already said that his team would be using the “spoiler” at the upcoming Argentina GP next weekend, and since last Sunday, we also know that Aprilia Racing also has a similar “spoiler” do use on their bike, and they will have it ready to use in competition by the Texas GP, at the Circuit of the Americas in a few weeks’ time.

With this decision made public today, the FIM hopes that all this controversy finally ends, but given that Aprilia, Honda, KTM, and Suzuki, all have the chance to continue with another appeal, it’s quite possible that over the next few days we will see more actions being taken by one, or more, of these teams.
